Terms and conditions of use for MedicineWise

These terms and conditions are made between National Prescribing Service Limited ("we" or "us" or "NPS MedicineWise") and you ("you" or "your") and govern, your use and our responsibility, of our consumer health management product ("MedicineWise app") app (the "Agreement").

 

Privacy statement

First some information about us: NPS MedicineWise is the only independent organisation in Australia working at a national level to positively change the attitudes and behaviours that exist around the use of medicines and medical tests, so that consumers and health professionals are equipped to make the best decisions when it counts. We are an independent, not-for-profit and evidence-based organisation.

The MedicineWise app aims to support a patient's health outcomes by helping them to take their medicines as directed and providing a convenient location to store, access and share their relevant health information. This will help you to have easy and meaningful conversations with the people in their care team. We will also use the information you enter to provide relevant health information back to you. 'Patient' could be you or someone you care for.

In order for us to do this, we require certain information about the patient. This may include the patient's personal details, such as date of birth and Medicare card number, the medicines the patient is taking, any relevant health conditions, contact details for the patient's health care team and any measurements and test results. This information will be securely stored in Sydney, Australia, on Amazon infrastructure, in line with the Australian Privacy Principles.

We will be storing this information so that you can access it from multiple devices, and restore the patient data into MedicineWise app if you need to, for example when you upgrade your phone.

The patient's information may also be de-identified and analysed to create better health outcomes for the Australian community. This analysis may be completed by us or by third parties, however no personal information will be shared with third parties, unless you have specifically opted-in for a service that requires this disclosure. We will clearly communicate with you when a service will involve transferring personal information to a third party, who that party is and what they will do with the information.

We may be required by law or as authorised under the Privacy Act 1988 (Cth) to release personal information to a third party, please email the privacy officer or phone 02 8217 8798 if you have any questions. Your obligations

If you are operating the app on behalf of someone else, you must have that person's consent or authority to share their personal information with us. In accepting these terms and conditions you confirm that you have obtained that consent. It is your obligation to take all reasonable steps to ensure that no unauthorised person shall have access to the app or the personal information contained in it. 

 

License

The purpose of this Agreement is to allow you to use the app (including any updates). The app means all databases, data, and documentation, which may be used by you to manage medicines and other health information to create better health outcomes, for either yourself or those you care for. The app is currently made available to you free of charge but we reserve the right to amend or withdraw the app, or charge for the app or service provided to you at any time and for any reason. We will notify you prior to making such changes.

 

Internet and data charges

As you know, the app is provided over the internet and mobile phone networks and accordingly the quality, speed, availability and reliability of the app may be affected by factors outside our control. You should also be aware that the terms and conditions of use of your mobile network and internet provider continue to apply to you in relation to your use of the app and you may incur charges when using the app.

 

Support and upgrades

We wish to provide you with an app which is easy to use and up to date. When updates are issued we may require you to install these in order to continue using the app. If you experience any difficulties, we may be able to help. Some of the content on the app is provided by third parties. While we endeavour to ensure the correctness of this content, we cannot guarantee its validity, or accuracy, including any recommended applications.

 

Limitation of use

Please be aware that the app is not a substitute for medical advice. Any personalised notifications, information or medical issues should be discussed with a qualified health care professional before being acted on. If in doubt, please seek medical advice. The information provided is accurate at the time of publication, but may change over time. Incidentally, being entirely independent means we do not endorse or recommend any brands, products (including medicines), tests, treatments or procedures mentioned in the app or the Content. These are provided for information only. While we are proud of our app and believe it will be of great benefit to you, we are unable to guarantee its performance. In the event of any issues, our liability will be limited to the license fees paid to use the app.

 

Termination

You may terminate this Agreement at any time or simply stop using the app. We may also terminate the app, or modify or terminate services and/or product offerings in connection with the app, however we will give you 30 days' notice prior to making any change.

 

General prohibitions

While we want you to enjoy using the app we also need to protect it. We ask that you only use the app for the purpose for which it is provided and for no other purpose.

Please be aware that the app is also protected by copyright and other intellectual property laws. This means that while you are licensed to use it, this use does not transfer any right, title, or interest in the app. We retain these rights including rights in any modifications or improvements regardless of who makes them.

 

General

This Agreement constitutes the entire agreement between the parties. This Agreement is personal to you and may not be assigned to anyone else.
